Interior Ministry statement on the Imamoglu investigation

An investigation has been opened against the mayor of Istanbul Metropolitan Municipality, Ekrem İmamoğlu, including allegations regarding the visit to the tomb of Fatih Sultan Mehmet Han, and it was confirmed today by the Deputy Minister of Istanbul. Interior İsmail Çataklı.

Çataklı said that in addition to the allegation that he visited HDP presidents and praised the criminal, there was an investigation that included allegations that İmamoğlu had disrespected during his visit to the grave.

Contrary to what is repeated in the news in question, the action carried out by our ministry is not an investigation, but a preliminary investigation opened at the request of the public prosecutor’s office. The preliminary examination is carried out in accordance with Law No. 4483 on the judgment of civil servants and other public officials and aims to reveal whether the complaint is such as to oblige the prosecution to investigate. Following the preliminary examination, if sufficient evidence is obtained to require an investigation by the prosecution, an investigation authorization is granted by the competent authority, otherwise it is not granted.

In accordance with Article 6 of Law No. 4483; In order to complete the preliminary examination process, it is mandatory to take the statement of the inspected official or other public official. Asking for a statement does not necessarily mean that the public official will be allowed to investigate, but it is a routine procedure that must be performed by the inspector as it is a legally recognized right to present a statement. defense.

During this preliminary examination process, which was initiated at the request of the Public Prosecutor’s Office, a statement was requested from the mayor of Istanbul Metropolitan Municipality, as well as other officials. Following receipt of the declaration, a preliminary examination report will be prepared by the inspector with the opinion as “leave to investigate” or “not to give”, and the process will be completed by the decision of the competent authority and the notification to the parties concerned. ”
